The Australian Fisheries Management Authority must make another agreement with the Minister under section 146 in relation to the Authority's policy for managing the fishery, unless there is a plan of management in force for the fishery under the Fisheries Management Act 1991 .

The Minister administering the Torres Strait Fisheries Act 1984 must make another agreement under section 146 in relation to the policy or plan for managing fishing (as defined in the Torres Strait Fisheries Act 1984 ) in an area of Australian jurisdiction (as defined in that Act).
