ENVIRONMENT PROTECTION AND BIODIVERSITY CONSERVATION ACT 1999 - SECT 444
Authorised person may ask for person's name and address
- (1)
- An authorised officer may ask an individual to tell the authorised officer
the individual's name and address if the authorised officer has reasonable
grounds to suspect that the individual has been involved in the commission of
an offence against this Act or the regulations.
- (2)
- Subject to subsection (4), a person must not refuse or fail to comply with
a request under subsection (1).
Penalty: 10 penalty units.
- (3)
- A person is guilty of an offence punishable
upon conviction by a fine not exceeding 10 penalty units if the person:
- (a)
- in purported compliance with a request under subsection (1), gives a name
and address; and
- (b)
- does so knowing the name or address is false or misleading.
- (4)
- If an authorised officer makes a request of a person under subsection (1),
the person is not required to comply with the request unless:
- (a)
- if the authorised officer is a member of a police forcehe or she
produces, for inspection by the person, written evidence of the fact that he
or she is a member of that police force; or
- (b)
- in any other casethe authorised officer produces his or her identity
card for inspection by the person.
