Commonwealth Numbered Acts Commonwealth Numbered Acts(1) Despite subsections 104(2) and (3) of the Regulatory Powers Act, the amount to be stated in an infringement notice for the purposes of paragraph 104(1)(f) of that Act, in relation to a civil penalty provision, is the following:
(a) if the notice relates to only one alleged contravention of the provision by the person--one-fifth of the maximum penalty that a court could impose on the person for the contravention;
(b) if the notice relates to more than one alleged contravention of the provision by the person--one-fifth of the amount worked out by adding together the maximum penalty that a court could impose on the person for each alleged contravention.
(2) Despite subsection (1), if a civil penalty provision of this Act is prescribed by the rules for the purposes of this subsection, the amount to be stated in the notice is the amount prescribed by the rules for the provision (which must be lower than the amount mentioned in subsection (1)).
