FUEL SECURITY ACT 2021 (NO. 65, 2021) - SECT 82

Delegation by Minister

             (1)  Subject to subsection (2), the Minister may, in writing, delegate the Minister's functions or powers under Part 3 (fuel security services payment) or this Part, or under rules made for the purposes of Part 3 or this Part, to:

                     (a)  the Secretary; or

                     (b)  an SES employee, or an acting SES employee, in the Department.

Note 1:       The expressions SES employee and acting SES employee are defined in section 2B of the Acts Interpretation Act 1901 .

Note 2:       Sections 34AA to 34A of the Acts Interpretation Act 1901 contain provisions relating to delegations.

             (2)  The Minister must not delegate the Minister's power:

                     (a)  to make guidelines under subsection 43(4); or

                     (b)  to make rules under section 84.

             (3)  In performing a delegated function or exercising a delegated power, the delegate must comply with any written directions of the Minister.
