Health Acts Amendment Act 1981 No. 118 of 1981 - SECT 90

90. Section 25 of the Principal Act is amended-

   (a)  by inserting ''(unless section 41 of the Acts Interpretation Act 1901
        in its application in relation to that provision otherwise provides
        that the
person is guilty of an offence)'' before ''guilty'' in sub-section (1); and

   (b)  by omitting sub-sections (2) and (3) and substituting the following
        sub-sections:

''(2) Subject to sub-section 25A (1), an offence against this Act (other than
an offence against sub-section 9 (2), 9 (2A), 23G (4), 23M (7), 23M (8) or 25B
(1)) is an indictable offence.

''(3) Subject to sub-section 25A (2), the punishment for an offence against
this Act (other than an offence against sub-section 9 (2), 9 (2A), 23G (4),
23M (7), 23M (8) or 25B (1)) is punishable on conviction-

   (a)  if the offender is a natural person-by a fine not exceeding $10,000 or
        imprisonment for a period not exceeding 2 years, or both; or

   (b)  if the offender is a body corporate-by a fine not exceeding
        $50,000.''.
