HIGHER EDUCATION FUNDING AMENDMENT ACT (No. 2) 1992 No. 158 of 1992 - SECT 23

23. Section 31 of the Principal Act is amended:

   (a)  by omitting from subsection (3) "to the State in which the institution
is situated," and substituting " to the institution";

   (b)  by omitting subsection (4) and substituting the following subsection:

"(4) If an amount has been determined under paragraph (2)(a) as the estimated
maximum Commonwealth contribution towards a capital project, the total of:

   (a)  the amounts payable to a State under subsection (3) as in force before
        1 January 1993 in relation to the project; and

   (b)  the amounts payable to an institution under subsection (3) as in force
        on or after that day in relation to the project; must not exceed the
        amount so determined.";

   (c)  by omitting from subsection (6) "or to the State in which the
        institution is situated, as the case may be,". Note: section 31 of the
        Principal Act is subsequently repealed by section 52 of this Act.
