REPATRIATION LEGISLATION AMENDMENT ACT 1984 No. 97, 1984 - SECT 30
30. (1) Section 12 of the Principal Act is repealed and the following section
is substituted: Delegation
"12. (1) The Commission may, either generally or as otherwise provided by the
instrument of delegation, by writing under its seal, delegate to a member of
the Commission, or to an officer or employee of the Department, all or any of
its powers and functions under this Act or the regulations, or under the
provisions of the Repatriation Act as applied by section 7 of this Act, other
than this power of delegation.
"(2) A power or function so delegated, when exercised or performed by the
delegate, shall, for the purposes of this Act, the regulations and the
provisions of the Repatriation Act applied by section 7 of this Act, be deemed
to have been exercised or performed by the Commission.
"(3) A delegation of a power or function under this section does not prevent
the exercise of the power, or the performance of the function, by the
Commission.".
(2) An instrument of delegation in force immediately before the commencement
of this Act under section 12 of the Principal Act continues in force after the
commencement of this Act as if it had been made under section 12 of the
Principal Act as amended by this Act.
