STATES GRANTS (PRIMARY AND SECONDARY EDUCATION ASSISTANCE) ACT 1996 No. 70, 1996 - SECT 20

(1) This section applies if:

   (a)  under a provision of an agreement made under Division 2 between the
        Commonwealth and the relevant authority of a non-government body, the
        Minister, or the relevant Minister, as the case may be, has determined
        that the authority should pay an amount to the Commonwealth; and

   (b)  an amount (the amount payable) that is the whole or a part of the
        amount referred to in paragraph (a) remains unpaid.

(2) The Minister may make a determination reducing an amount that is payable
to a State for the non-government body under any provision of this Act in any
program year by an amount not greater than the amount payable.

(3) The Minister may make a determination increasing the maximum amount that
may be paid to the States for any purpose under any provision of this Act in
any program year by an amount that is not greater, or amounts the sum of which
is not greater, than the amount of any reduction effected under subsection (2)
(whether the reduction was effected in relation to the same provision, or a
different provision, of this Act).
