STATES GRANTS (PRIMARY AND SECONDARY EDUCATION ASSISTANCE) ACT 1996 No. 70, 1996 - SECT 21

If the Minister is considering whether to make:

   (a)  a determination under paragraph 11(b), 13(a), 14(a) or 18(a) that a
        State should repay an amount to the Commonwealth; or

   (b)  a determination under a provision of an agreement referred to in
        paragraph 16(6)(a) or (7)(a) or subsection 16(8) that the relevant
        authority of a non-government body should pay an amount to the
        Commonwealth; the Minister must take into account all relevant
        matters, including whether the State or authority gave all relevant
        information to the Commonwealth before the relevant grant of financial
        assistance was made.
