STATES GRANTS (PRIMARY AND SECONDARY EDUCATION ASSISTANCE) ACT 1996 No. 70, 1996 - SECT 45

(1) The Minister may make a determination approving a capital grant that may
be authorised to be paid to a State under section 46 for a capital project or
capital projects in connection with government schools or government rural
student hostels, or both, in the State for a program year.

(2) Without limiting subsection (1), the Minister may make a determination
setting out the total amount of the capital grants that may be approved under
subsection (1) in respect of a State for a particular program year for
projects referred to in that subsection.

(3) The Minister must not vary the amount of a capital grant approved under
subsection (1) for a project or projects if the variation would result in the
total amount of the capital grants approved under this section for a State for
a program year being greater than the total amount determined for the State
under subsection (2) for the program year.
