TRADEX SCHEME ACT 1999 - SECT 15

Holder to notify ineligibility
(1)
If the holder of a tradex order:

(a)
becomes aware that the holder was ineligible to apply for the order; or

(b)
becomes ineligible to hold the order;

the holder must, within 7 days after becoming aware as mentioned in paragraph
(a)
or becoming ineligible as mentioned in paragraph (b), give notice to the Secretary in accordance with subsection (2).

Note: The Secretary has power to extend the period referred to in subsection (1) (see section 43).

(2)
The notice must:

(a)
be in writing; and

(b)
be in accordance with the approved form; and

(c)
state the tradex number allocated to the order; and

(d)
state that the holder was ineligible to apply for the order, or has become ineligible to hold the order, as the case may be; and

(e)
set out particulars of the circumstances that gave rise to the ineligibility; and

(f)
contain such other information as the form requires; and

(g)
be signed in the manner indicated in the form; and

(h)
be lodged with the Secretary.
