TRADEX SCHEME ACT 1999 - SECT 16

Notice to show cause why tradex order should not be revoked
If it appears to the Secretary that any circumstances (other than circumstances specified in a notice given to the Secretary under section 15) that may be disqualifying circumstances exist in relation to the holder of a tradex order, the Secretary must cause to be given to the holder a written notice:

(a)
setting out particulars of the circumstances; and

(b)
inviting the holder to give to the Secretary, within 28 days after the day on which the notice is received by the holder, written evidence:

(i)
that the circumstances do not exist; or
(ii)
if the circumstances exist—that they are not disqualifying circumstances.
Note: The Secretary has power to extend the period referred to in paragraph 16(b) (see section 43).
