Existing users under the Texco Scheme

(a): was, immediately before the commencement of this Act, a user, in relation to goods of a particular kind or description, under the Texco Scheme; and
(b): had, before that commencement, given a written notice to the Secretary (however the notice was expressed) to the effect that the person wished to import goods of that kind or description under the Tradex Scheme;

the Secretary must, as soon as practicable, make under section 11, in respect of goods of that kind or description, such a tradex order as would have been made if the person had duly made an application for the order under section 10.
