1990 No. 443 AUSTUDY REGULATIONS - REG 108

Insufficient information or evidence
108. (1) An authorised person 1 can give a student a notice asking for further
information or evidence if the Department has insufficient information or
evidence about his or her application for AUSTUDY.

(2) An authorised person can also give another person a notice asking for
information or evidence that is relevant to the application but only if:

   (a)  the authorised person believes on reasonable grounds that the person
        has the information or evidence; and

   (b)  a copy of the notice is also sent to the student.

(3) The notice must:

   (a)  say what information or evidence is needed; and

   (b)  say that AUSTUDY cannot be paid until the information or evidence is
        supplied.

(4) If the information or evidence is not supplied within 14 days, AUSTUDY
cannot be paid until it is supplied or the notice is withdrawn. Note to
regulation 108 1 An authorised person is a departmental officer who can
approve the payment of AUSTUDY. Decisions of an authorised person can be
appealed to the Student Assistance Review Tribunal.
