1993 No. 367 AUSTUDY REGULATIONS (AMENDMENT) - REG 4

4.1 Add at the end:

"(2) Subject to subregulation (3), a student is not eligible to get AUSTUDY
before the student turns 17 if he or she:

   (a)  turns 16 on or after 1 March 1994; and

   (b)  is a secondary student attending a secondary school; and

   (c)  is not entitled to get a living allowance mentioned in paragraph 60
        (a) (independent) or paragraph 60 (b) (away-from-home) or a pensioner
        education supplement under subregulation 98 (2).

"(3) A student is eligible to get AUSTUDY before the student turns 17 if he or
she is not a dependent child within the meaning of subsection 5 (4) of the
Social Security Act 1991 for the purposes of Part 2.17 of that Act.".
