1988 NO. 158 CIVIL AVIATION REGULATIONS - REG 26

Suspension or cancellation of a certificate of airworthiness
26. (1) Where the Authority has reasonable grounds to believe that the safety
of an Australian aircraft or of Australian aircraft included in a type of
aircraft is in doubt, the Authority may suspend the certificate of
airworthiness of the aircraft or of each Australian aircraft included in the
type of aircraft, as the case may be, for such period as the Authority
considers necessary to resolve the doubt.

(2) Where the Authority is satisfied that it is not safe to fly an Australian
aircraft or Australian aircraft included in a type of aircraft, the Authority
may suspend or cancel the certificate of airworthiness of the aircraft or of
each Australian aircraft included in the type of aircraft, as the case may be.

(3) Where the Authority is satisfied, with respect to an Australian aircraft,
that a condition set out in, or applying in relation to, the
certificate of airworthiness of the aircraft has not been complied with, the
Authority may suspend or cancel the certificate of airworthiness.

(4) A suspension or cancellation of a certificate of airworthiness of an
Australian aircraft under this regulation does not have effect in relation to
a person until a notification of the suspension or cancellation has been
served by post on the person or the fact of the suspension or cancellation has
otherwise been brought to his or her attention.
