1984 No. 425 FAMILY LAW RULES - ORDER 8 RULE 1
Proceedings instituted by one party
1. Where, in proceedings for dissolution of marriage-
(a) the applicant has filed a request in accordance with Form 9 that the
court determine the proceedings in the absence of the parties;
(b) the applicant has served on the respondent, not less than 28 days
before the date fixed for the hearing of the proceedings, a copy of
the request; and
(c) at the date fixed for the hearing of those proceedings-
(i) there are no children of the marriage who have not attained the
age of 18 years;
(ii) the respondent has not requested the Court not to determine the
proceedings in the absence of the parties; and
(iii) no answer to the application for dissolution of marriage has
been filed, the Court may, in its discretion, determine the
proceedings notwithstanding that neither the parties to the
proceedings nor their legal representatives are present in
Court.
