1989 No. 175 FAMILY LAW RULES (AMENDMENT) - RULE 14

14. Order 16 of the Family Law Rules is repealed and the following Order
substituted:

"ORDER 16
REQUIREMENTS FOR CERTAIN APPLICATIONS Applications under section 87

"1. (1) Where an application is filed for approval of a maintenance agreement
under section 87 of the Act, the applicant shall, unless such document is
already filed, file with the application:

   (a)  a statement or affidavit in accordance with Order 17, rule 2; and

   (b)  any affidavit or other document necessary to support the application
        and relevant to the question whether the provisions of the agreement
        with respect to financial matters are proper.

"(2) Before the return day of the application, the respondent shall file:

   (a)  a statement or affidavit in accordance with Order 17, rule 2; and

   (b)  any affidavit or other document necessary to support the respondent's
        position in relation to the application and relevant to the question
        whether the provisions of the agreement with respect to financial
        matters are proper. Urgent interim or interlocutory applications

"2. Where an urgent interim or interlocutory application is filed, the
applicant shall file with the application an affidavit setting out:

   (a)  the circumstances of urgency; and

   (b)  only those facts and matters that are reasonably necessary to support
        the application.".
