FISHERIES MANAGEMENT (SOUTHERN AND EASTERN SCALEFISH AND SHARK FISHERY) REGULATIONS 2004 2004 No. 336 - REG 4

Integrated computer vessel monitoring system (Act s 168)

(1) For paragraph 168 (2) (n) of the Act, the holder of a boat statutory fishing right must have an ICVMS that complies with subregulation (2) installed correctly on board the boat before it is used for fishing in the fishery, unless AFMA has given written approval otherwise.

Penalty:
25 penalty units.

(2)
The ICVMS must:

(a)
be installed in accordance with the requirements set out in the document called `Vessel Monitoring System — Installation and Maintenance Standards' published by AFMA on 26 November 2004; and

(b)
include an ALC of a kind approved by AFMA; and

Note
ALCs already approved by AFMA are listed on AFMA's website: www.afma.gov.au.

(c)
unless AFMA has given permission in writing to the contrary — include a personal computer capable of sending and receiving e-mail; and

(d)
be operated in accordance with its manufacturer's instructions.

(3)
Once installed, the holder must ensure that the ICVMS not be switched to a state that:

(a)
does not report the boat's position; or

(b)
is a lower power mode than that used in normal operation of the ICVMS;

unless AFMA has given permission otherwise.

Penalty:
25 penalty units.

Note
Some manufacturers refer to the lower power mode as `sleep mode'.
