1991 No. 370 PUBLIC SERVICE (PARLIAMENTARY OFFICERS) REGULATIONS - REG 12

Circumstances in which recreation leave is taken to be granted if an officer is already on leave on 1 August in a year for 4 weeks or more
12. (1) This regulation applies to an officer if:

   (a)  on 1 August in a year, the officer is on recreation leave for a period
that is equal to or more than 4 weeks (in this regulation called "August
leave"); and

   (b)  the recreation leave credit available to the officer on 1 August in
        the year will exceed the recreation leave limit when the August leave
        ends.

(2) If:

   (a)  the officer applies for recreation leave that is to be taken no later
        than 6 months after the end of the August leave; and

   (b)  the recreation leave includes all or part of the excess period; and

   (c)  the Secretary considers that it would not be convenient for the
        working of the Department to grant recreation leave to the officer at
        the time referred to in the application; and

   (d)  the officer agrees to a change in the date on which the recreation
        leave will commence; the Secretary may specify in writing a different
        day, between the time that the officer applies and the end of 6 months
        after the end of the August leave, as the day on which the recreation
        leave commences.

(3) If:

   (a)  the officer applies for recreation leave that is to be taken no later
        than 6 months after the end of the August leave; and

   (b)  the recreation leave includes all or part of the excess period; and

   (c)  the officer does not agree to a change in the date on which the
        recreation leave will commence; the Secretary must grant the
        recreation leave.

(4) The officer is taken to be granted recreation leave for the excess period,
commencing on the day 6 months after the August leave ends, if:

   (a)  the officer is on August leave; and

   (b)  the recreation leave credit available to the officer on 1 August in
        the year is more than the recreation leave limit; and

   (c)  the officer does not, within 6 months after the August leave ends,
        take recreation leave for a period that includes all or part of the
        excess period.
