STRONGER FUTURES IN THE NORTHERN TERRITORY REGULATION 2013 (SLI NO 184 OF 2013) - REG 7

Modification of Associations Act (NT)--community living areas

                   For paragraph 35(1)(b) of the Act, the Associations Act (NT), to the extent that the Associations Act (NT) applies to a community living area, is modified as set out in Schedule 7.

Note:          For the definition of community living area , see subsection 35(2) of the Act.

1  At the end of subsection 110(1)

Add:

Note:          See subsection (6A) for circumstances in which the consent of the Minister is not required in relation to certain kinds of leases and licences.

2  Paragraph 110(6)(d)

After "a lease", insert "or licence".

3  Paragraph 110(6)(d)

After "the lease", insert "or licence".

4  At the end of subsection 110(6)

Add:

               ; or (e)  to grant a lease or licence in relation to part of the land to an incorporated association, an incorporated trading association, an Aboriginal or Torres Strait Islander corporation or a person, for any purpose related to a use or development allowed under the Northern Territory Planning Scheme , including the following:

                              (i)  commercial purposes, including a community store;

                             (ii)  purposes relating to infrastructure;

                            (iii)  public purposes, including the provision of essential services.

5  After subsection 110(6)

Insert:

          (6A)  The consent of the Minister mentioned in subsection (1) is not required for a lease or licence mentioned in paragraph (6)(d) or (e), if the lease or licence is for a term of 10 years or less.

6  At the end of subsection 110(7)

Add:

Note:          See subsection (8A) for circumstances in which the consent of the Minister is not required.

7  Paragraph 110(8)(d)

After "a lease", insert "or licence".

8  Paragraph 110(8)(d)

After "the lease", insert "or licence".

9  At the end of subsection 110(8)

Add:

10  After subsection 110(8)

Insert:

          (8A)  The consent of the Minister mentioned in subsection (7) is not required for a lease or licence mentioned in paragraph (8)(d) or (e), if the lease or licence is for a term of 10 years or less.

11  Subsection 110(14)

Insert:

"Northern Territory Planning Scheme" means the scheme with that title, published by the Government of the Northern Territory, as in force when this definition commences.
