1994 No. 57 SUPERANNUATION INDUSTRY (SUPERVISION) REGULATIONS - REG 2.41
Specific requirements
2.41. (1) Subject to subregulation (2), the trustee of a superannuation entity
(other than an excluded fund) must give to a person, on request in writing by
the person, a copy of any of the following documents (to the extent the
trustee has access to the documents) specified in the request:
(a) the governing rules of the superannuation entity;
(b) audited accounts of the superannuation entity, together with (whether
or not specifically requested) the auditor's report in relation to the
accounts;
(c) the most recent actuarial report (as referred to in regulation 9.30)
on the entity, and any subsequent written advice by an actuary to the
trustee, to the extent that those documents are relevant to:
(i) the overall financial condition of the entity; or
(ii) the entitlements of the person;
(d) in the case of a regulated superannuation fund or approved deposit
fund-a copy of information given under Subdivision 2.4.3 that was most
recently given to the members;
(e) in the case of a PST-a copy of the information required to be given
under paragraph 2.59 (b), regulation 2.60 (other than under paragraph
2.60 (a)) and regulation 2.61 that was most recently given to the
members.
(2) If the person requesting the information is not a concerned person (as
defined in subregulation 2.40 (3)), the trustee need not give to the person
the documents referred to in paragraphs (1) (a) and (c).
