TRADE PRACTICES REGULATIONS AMENDMENT1979 No. 1 - REG 15

Continuance of proceedings and matters notwithstanding non-compliance with Regulations or direction
Regulation 26 of the Trade Practices Regulations is amended—

(a)
by omitting sub-regulation (1) and substituting the following sub-regulations:—

"(1) Subject to sub-section 172 (3) of the Act and to these Regulations, the failure by a person in or in relation to a proceeding or matter before the Commission to comply with a provision of these Regulations does not, unless the Commission otherwise directs, prevent the proceeding or matter being dealt with as if the person had complied with the provision.

"(1A) Subject to sub-section 172 (3) of the Act and to these Regulations, the failure by a person in or in relation to a proceeding or matter before the Tribunal to comply with a provision of these Regulations or with a direction of the Tribunal under these Regulations does not, unless the Tribunal otherwise directs, prevent the proceeding or matter being dealt with as if the person has complied with the provision or direction.";

(b)
by inserting in paragraph (a) of sub-regulation (2), after the word and figures "sub-section 101 (1)", the words and figures ", or under section 101A,"; and

(c)
by omitting from paragraph (b) of sub-regulation (2) the words "Forms 1 to 6 (inclusive)" and substituting the words "Forms A to G (inclusive)".
