1986 No. 203 TRADE UNION TRAINING AUTHORITY REGULATIONS - REG 9
Termination of appointment
9. (1) In its application to and in relation to a member of the Council,
section 28 of the Act applies subject to the following modifications:
(a) omit sub-section (1);
(b) omit sub-sections (2), (3) and (3a), substitute the following
sub-sections:
"(2) The Minister may terminate the appointment of a member of the Council for
misbehaviour or physical or mental incapacity.
"(3) If-
(a) a member of the Council becomes bankrupt, applies to take the benefit
of any law for the relief of bankrupt or insolvent debtors, compounds
with the member's creditors or makes an assignment of the member's
remuneration for their benefit; or
(b) a member of the Council referred to in paragraph 5 (1) (d) or (e) of
the Trade Union Training Authority Regulations ceases to be an officer
or employee of the Authority,
the Minister shall terminate the appointment of the member.
"(3A) The Minister may terminate the appointment of a member of the Council
referred to in paragraph 5 (1) (c) or (f) of the Trade Union Training
Authority Regulations if the organization represented by the member notifies
the Minister in writing that it no longer wishes to be represented by that
member.
"(4) In this section, 'Council' means the Council for Union Training for the
Australian Capital Territory.".
(2) The Minister may terminate the appointment of a deputy member of the
Council in relation to a member referred to in paragraph 5 (1) (c) or (f) for
misbehaviour or physical or mental incapacity.
(3) If a deputy member of the Council in relation to a member referred to in
paragraph 5 (1) (c) or (f) becomes bankrupt, applies to take the benefit of
any law for the relief of bankrupt or insolvent debtors, compounds with the
deputy member's creditors or makes an assignment of the deputy member's
remuneration for their benefit, the Minister shall terminate the appointment
of the deputy member.
(4) The Minister may terminate the appointment of a deputy member of the
Council in relation to a member referred to in paragraph 5 (1) (c) or (f) if
the organization that the member represents notifies the Minister in writing
that it wishes the appointment of that deputy member to be terminated.
