BIOSECURITY ACT 2015 - SECT 173
Grounds for suspension or cancellation of biosecurity registration
(1) Each of the following constitutes grounds for suspending or cancelling
biosecurity registration-- (a) the Secretary is of the opinion that the
registered entity has contravened a requirement imposed by or under this Act,
(b) the Secretary is of the opinion that the registered entity is not a
suitable person to be involved in the registrable dealing concerned,
(c) the
Secretary receives information about the registered entity and the Secretary
is of the opinion that, had the information been received at the time when the
application for biosecurity registration or renewal of biosecurity
registration was made, the Secretary would have refused the application,
(d)
any other grounds prescribed by the regulations.
(2) The Secretary may also
suspend or cancel biosecurity registration in the case of an emergency (in
which case, the emergency is the grounds for the suspension or cancellation).
(3) A decision about the suitability of a person to be involved in a
registrable dealing may be made having regard to any of the following-- (a)
the fact that the person has been found guilty of an offence under this Act or
the regulations, or an offence under any other Act or law,
(b) a biosecurity
audit,
(c) any matter prescribed by the regulations,
(d) any other
circumstances that the Secretary considers relevant.
(4) In this Division--
"registered entity" includes a former registered entity.
