BIOSECURITY ACT 2015 - SECT 188
False biosecurity certificates
188 False biosecurity certificates
(1) A person who issues, or purports to issue, a biosecurity certificate or
purported biosecurity certificate is guilty of an offence if the certificate
is false or misleading in a material particular.
(2) A person who alters or
amends a biosecurity certificate, or purported biosecurity certificate, is
guilty of an offence if the alteration or amendment makes the certificate
false or misleading in a material particular.
(3) A certificate is false or
misleading in a material particular if it-- (a) includes information that is
false or misleading in a material particular, or
(b) omits material
information.
(4) An offence against subsection (1) or (2) is a category 1
offence if the offence is committed intentionally or recklessly.
(5) In any
other case, an offence against subsection (1) or (2) is a category 2 offence.
(6) A category 1 offence or category 2 offence against subsection (1) or (2)
is an executive liability offence.
(7) In this section--
"biosecurity certificate" includes an interstate biosecurity certificate.
