Tenancy from year to year not to be implied
127 Tenancy from year to year not to be implied
(1) No tenancy from year to year shall, after the commencement of this Act, be
implied by payment of rent; if there is a tenancy, and no agreement as to its
duration, then such tenancy shall be deemed to be a tenancy determinable at
the will of either of the parties by one month's notice in writing expiring at
any time.
(2) This section shall not apply where there is a tenancy from year
to year which has arisen by implication before the commencement of this Act--
Provided that in the case of any such tenancy in respect of which the date of
its creation is unknown to the lessor or the lessee, as the case may be, who
is seeking to determine the same, such tenancy shall, subject to any express
agreement to the contrary, be determinable by six months' notice in writing
expiring on the thirtieth day of June, one thousand nine hundred and
twenty-one, or any date thereafter.
