Making of short term orders
36 Making of short term orders
(1) The Cemeteries Agency may, by order in writing given to a person who is an
operator of a type or of a class of cemetery, or persons who belong to a class
of such operators, require the person or persons to take such action or
refrain from taking such action as is specified in the order (a
"short term order" ).
(2) The Cemeteries Agency may make a short term order
if it considers the making of the order to be reasonably necessary in the
public interest to prevent or lessen a serious threat or risk to the
achievement of an object of this Act in the State or any part of the State
pending the making of a regulation under section 31 establishing an interment
industry scheme that makes provision for a
mandatory code of practice requirement.
(3) As soon as practicable after
making a short term order, the Cemeteries Agency must recommend to the
Minister that the regulation referred to in subsection (2) be made as a matter
of urgency.
(4) A short term order may be made without the concurrence of the
Ministers referred to in section 31 (4).
