Obstructing authorised person or other person

169 Obstructing authorised person or other person

(1) A person must not obstruct--
(a) an authorised person, or a person helping an authorised person, exercising a function under Schedule 2, unless the person has a reasonable excuse, or
(b) a person in the exercise of the person's functions under this Act.
: Maximum penalty--10 penalty units.
(2) If a person has obstructed an authorised person, a person helping an authorised person, or a person exercising a function under this Act (each a
"relevant person" ), and the relevant person decides to proceed with the exercise of the function, or to continue to perform the functions, the relevant person must give a warning to the person obstructing the relevant person that--
(a) it is an offence to cause an obstruction unless the person has a reasonable excuse, and
(b) the relevant person considers the person's conduct an obstruction.
(3) In this section--

"obstruct" includes assault, hinder, resist, attempt to obstruct and threaten to obstruct.
