(1) In this Division--
"child" means a person under the age of 18 years.
"conviction" includes a finding that the charge for an offence is proven, or that a person is guilty of an offence, even though the court does not proceed to a conviction, but does not include a conviction that is quashed by any court.
"current application" , in relation to a working with children check clearance, has the same meaning as it has in the Child Protection (Working with Children) Act 2012 .
"Presiding Officer" means the President of the Legislative Council or Speaker of the Legislative Assembly.
"relevant apprehended violence order" means (subject to subsection (2)) a final apprehended violence order made under the Crimes (Domestic and Personal Violence) Act 2007 , or a final order made under Part 15A of the Crimes Act 1900 before its repeal, being an order made on the application of a police officer or other public official for the protection of a child from sexual activity or sexual touching or a sexual act within the meaning of Division 10 of Part 3 of the Crimes Act 1900 .
"working with children check clearance" has the same meaning as it has in the Child Protection (Working with Children) Act 2012 .
(2) The following are not relevant apprehended violence orders--(a) an apprehended violence order made by a court before 3 July 1995 under Part 15A of the Crimes Act 1900 ,(b) an external protection order (within the meaning of section 562RA of the Crimes Act 1900 ) made before 3 July 1995,(c) an external protection order (within the meaning of Part 13 of the Crimes (Domestic and Personal Violence) Act 2007 ) that is not registered under that Part.
