LOCAL COURT ACT 2007 - SECT 16
Acting Magistrates
16 Acting Magistrates
(1) The Governor may, by commission under the public seal of the State,
appoint any person who is qualified for appointment as a Magistrate under
section 13 to act as a Magistrate for a term not exceeding 5 years to be
specified in the commission.
(2) A person who holds, or has held, a judicial
office of this State, or of the Commonwealth, another State or Territory, may
be appointed under this section even if he or she has reached the
mandatory judicial retirement age (or will have reached that age before the
appointment expires) but may not be so appointed for any period extending
beyond the day on which he or she reaches the age of 78 years.
(3) Part 4 of
Schedule 1 has effect with respect to acting Magistrates.
