MENTAL HEALTH AND COGNITIVE IMPAIRMENT FORENSIC PROVISIONS ACT 2020 - SECT 146
Tribunal may amend or impose conditions on release or leave orders on application of victims
146 Tribunal may amend or impose conditions on release or leave orders on
application of victims
(1) This section applies to an order of the Tribunal for the release of, or
granting leave of absence to, a forensic patient.
(2) A registered victim of
the patient may apply to the Tribunal for any of the following orders-- (a) an
order varying a non-association condition of an order to which this section
applies or imposing a non-association condition on an order to which this
section applies,
(b) an order varying a place restriction condition of an
order to which this section applies or imposing a place restriction condition
on an order to which this section applies.
(3) The Tribunal may, on an
application being made, vary the order to which this section applies or impose
any condition on the order or make any other order it may make under this
Part.
(4) In this section--
"non-association condition" means a condition imposed by the Tribunal relating
to the association or non-association by a forensic patient with victims or
victims' families.
"place restriction condition" means a condition imposed by the Tribunal
relating to the frequenting or visiting of places by a forensic patient.
