MENTAL HEALTH AND COGNITIVE IMPAIRMENT FORENSIC PROVISIONS ACT 2020 - SECT 164
Delegation
164 Delegation
(1) A Minister administering this Act may, by instrument in writing, delegate
the exercise of any function of the Minister under this Act (other than this
power of delegation)-- (a) to any person employed in a Department responsible
to the Minister, or
(b) to any person, or any class of persons, authorised
for the purposes of this section by the regulations.
(2) The Secretary of the
Department of Communities and Justice may delegate the exercise of any
function of the Secretary under this Act (other than this power of
delegation)-- (a) to any person employed in the Department of Communities and
Justice, or
(b) to any person, or any class of persons, authorised for the
purposes of this section by the regulations.
(3) Nothing in this section
limits the operation of section 21 of the Health Administration Act 1982 .
