PROTECTION OF THE ENVIRONMENT ADMINISTRATION ACT 1991 - SECT 35A

35A Exclusion of liability for certain statements

(1) No liability is incurred by the Crown and no personal liability is incurred by a protected person for a statement made or issued in good faith--

(a) under the Protection of the Environment Operations Act 1997 , section 319B, or

(b) in, or associated with, a recall notice within the meaning of the Protection of the Environment Operations Act 1997 .

(2) No liability is incurred by a person for publishing in good faith--

(a) a statement referred to in subsection (1), or

(b) a fair report or summary of the statement.

(3) In this section--

"liability" includes liability for defamation.

"protected person" has the same meaning as in section 35.
