RESIDENTIAL TENANCIES ACT 2010 - SECT 200
Search warrants
200 Search warrants
(1) An investigator may apply to an issuing officer for the issue of a search
warrant for premises if the investigator believes on reasonable grounds-- (a)
that a provision of this Act or the regulations is being or has been
contravened on the premises, or
(b) that there is on the premises evidence of
a contravention of this Act or the regulations.
(2) An issuing officer to
whom an application for a search warrant is made under this section may, if
satisfied that there are reasonable grounds for doing so, issue a search
warrant authorising an investigator named in the warrant and any other person
named in the warrant-- (a) to enter the premises concerned, and
(b) to search
the premises for evidence of a contravention of this Act or the regulations.
(2A) A police officer may accompany an investigator who enters premises and
searches for evidence under a search warrant as if the police officer were
named in the warrant.
(3) Division 4 of Part 5 of the Law Enforcement
(Powers and Responsibilities) Act 2002 applies to a search warrant issued
under this section.
(4) In this section--
"issuing officer" means an authorised officer within the meaning of the
Law Enforcement (Powers and Responsibilities) Act 2002 .
