Requirements for evidence of decennial insurance before issue of certain building certificates
211AH Requirements for evidence of decennial insurance before issue of certain
building certificates
(1) The regulations may prohibit the issue of one or more of the following
unless evidence of the issue of decennial insurance, or the giving of a
building bond under Division 3, has been given to the Secretary-- (a) a
complying development certificate under the
Environmental Planning and Assessment Act 1979 , or a certificate under that
Act, Part 6,
(b) a strata certificate within the meaning of the
Strata Schemes Development Act 2015 .
(2) The regulations may specify the
following-- (a) the type of evidence that must be given,
(b) the way in which
the evidence must be given to the Secretary.
(3) A certificate issued in
contravention of a prohibition under this section is invalid.
(4) To avoid
doubt, evidence of the issue of decennial insurance includes evidence of the
issue of a certificate of currency for decennial insurance that comes into
force on the occupation of a building.
