WORKPLACE INJURY MANAGEMENT AND WORKERS COMPENSATION ACT 1998 - SECT 235A
Fraud on workers compensation scheme
(1) A person who by deception obtains, or attempts to obtain, for himself or
herself any financial advantage in connection with the workers compensation
scheme under this Act or the 1987 Act is guilty of an offence if the person
knows or has reason to believe that the person is not eligible to receive that
financial advantage. : Maximum penalty--500 penalty units or imprisonment for
2 years, or both.
(2) A person who by deception obtains, or attempts to
obtain, for another person any financial advantage in connection with the
workers compensation scheme under this Act or the 1987 Act is guilty of an
offence if the person knows or has reason to believe that the other person is
not eligible to receive that financial advantage. : Maximum penalty--500
penalty units or imprisonment for 2 years, or both.
(3) A person is not
liable to be convicted of an offence against this section and any other
provision of this Act or the 1987 Act as a result of the same conduct.
(4) In
this section--
"deception" means any deception, by words or other conduct, as to fact or as
to law, including the making of a statement or the production of a document
that is false or misleading.
"financial advantage" includes a financial advantage for an injured worker (or
a person who claims to be an injured worker), an employer, an insurer or a
medical or other service provider.
