WORKPLACE INJURY MANAGEMENT AND WORKERS COMPENSATION ACT 1998 - SECT 238A
Search warrant
238A Search warrant
(1) An inspector may apply to an authorised officer within the meaning of the
Law Enforcement (Powers and Responsibilities) Act 2002 for a search warrant
if the inspector has reasonable grounds for believing that a provision of this
Act, the 1987 Act or the regulations under those Acts has been or is being or
is about to be contravened in or about any premises.
(2) An authorised
officer within the meaning of the
Law Enforcement (Powers and Responsibilities) Act 2002 to whom an application
is made under this section may, if satisfied that there are reasonable grounds
for doing so, issue a search warrant authorising the inspector named in the
warrant-- (a) to enter the premises, and
(b) to search the premises for
evidence of a contravention of this Act, the 1987 Act or the regulations under
those Acts, and
(c) to exercise in the premises any powers conferred on the
inspector under section 238.
(3) Division 4 of Part 5 of the Law Enforcement
(Powers and Responsibilities) Act 2002 applies to a search warrant issued
under this section.
(4) In this section--
"inspector" has the same meaning as it has in section 238.
"premises" has the same meaning as it has in section 238.
