(1) If a lot is a battle-axe lot or other lot with an access handle, the area of the access handle is not to be included in calculating the lot size.
(2) The minimum lot size of a lot that is a battle-axe lot is as follows--(a) if the lot is in Zone R1 General Residential and on land identified "North Wallarah Peninsula Area 3" on the Additional Permitted Uses Map --600m 2,(b) if the lot is in Zone R2 Low Density Residential--600m 2,(c) if the lot is in Zone R3 Medium Density Residential--1,500m 2.
(3) The minimum lot size of a lot that is a corner lot is as follows--(a) if the lot is in Zone R1 General Residential and on land identified "North Wallarah Peninsula Area 3" on the Additional Permitted Uses Map --500m 2,(b) if the lot is in Zone R2 Low Density Residential--500m 2,(c) if the lot is in Zone R3 Medium Density Residential--1,200m 2.
(4) Despite subclauses (2) and (3), development consent must not be granted to a subdivision that would result in more than 2 battle-axe lots with the same access handle as the only means of vehicular access to the road.
(5) This clause does not apply to the subdivision of land--(a) under clause 4.1A or 4.1B, or(b) in Zone R2 Low Density Residential in--(i) Catherine Hill Bay Village Precinct, or(ii) Middle Camp Village Precinct.
