This legislation has been repealed.
(1) For the purposes of section 5 of the Act:(a) the standards set out in Schedule 1 are prescribed for all private health facilities, and(b) a standard specified in Schedule 2 in relation to a specified class of private health facility is prescribed for private health facilities of that class.
(2) The licensee of a private health facility must ensure that the private health facility is conducted in accordance with the provisions of Schedules 1 and 2 applicable to the private health facility.Maximum penalty (subclause (2)): 5 penalty units.
(3) A licensee is not guilty of an offence under this clause if the licensee:(a) was not aware of the circumstances giving rise to the alleged offence, and(b) could not reasonably be expected to have been aware of those circumstances.
(4) A contravention of a provision of Schedule 1 or 2 by any person other than the licensee does not constitute an offence under this Regulation.
