Northern Territory Consolidated Acts Northern Territory Consolidated Acts(1) A person must not obstruct an authorised officer, or person assisting an authorised officer (the assistant ), acting in an official capacity.
Fault elements:
The person:
(a) knows the officer or assistant is acting in an official capacity; and
(b) intentionally obstructs the officer or assistant.
Maximum penalty: 50 penalty units or imprisonment for 6 months.
(2) It is a defence to a prosecution for an offence against subsection (1) if the defendant has a reasonable excuse.
(3) In this section:
"obstruct" includes resist and hinder.
