(1) A person commits an offence if:
(a) the person is a registered person; and
(b) the person intentionally:
(i) uses an animal for scientific purposes; or
(ii) allows an animal to be used for scientific purposes; and
(c) there is no project approval in force for the use.
Maximum penalty: 100 penalty units or imprisonment for 12 months.
(2) A person commits an offence if:
(a) the person is a registered person; and
(b) the person intentionally:
(i) uses an animal for scientific purposes; or
(ii) allows an animal to be used for scientific purposes; and
(c) there is a project approval in force for the use; and
(d) the use results in a contravention of the project approval or its conditions and the person is reckless in relation to that result.
Maximum penalty: 100 penalty units or imprisonment for 12 months.
(3) Strict liability applies to subsections (1)(a) and (c) and (2)(a) and (c).
