ADOPTION ACT 2009 - SECT 280
Who is eligible to take part
280 Who is eligible to take part
(1) A party to the proposed adoption of a child may take part in the mailbox
service while an interim order for the child is in force.
(2) However, the
child may take part only with the written consent of the chief executive
and— (a) if an adoption plan is required under section 169A —the parties
to the adoption plan; or
(b) otherwise—the parties to the proposed
adoption.
(3) A party to an adoption may take part in the mailbox service.
(4) However, while an adopted person is a child, the adopted person may take
part only with the written consent of an adoptive parent.
(5) An adult
relative of a birth parent who is not a party to the adoption may take part
if— (a) the birth parent gives consent, does not have capacity to give
consent or has died; or
(b) the chief executive can not locate the birth
parent after making all reasonable enquiries.
(6) A consent under this
section may be limited to exchanging non-identifying information.
