ADOPTION ACT 2009 - SECT 321

321 Protection from liability

(1) An official does not incur civil liability for an act done, or omission made, honestly and without negligence under this Act.

(2) If subsection (1) prevents a civil liability attaching to an official, the liability attaches instead to the State.

(3) In this section—

"official" means—

(a) a public service employee; or

(b) an adoption contract worker, counsellor or other person engaged by the chief executive; or

(c) an approved carer; or

(d) an independent Aboriginal or Torres Strait Islander entity, or member of an independent Aboriginal or Torres Strait Islander entity, for an Aboriginal or Torres Strait Islander child.
