Minister to consider representations and give notice of decision
18 Minister to consider representations and give notice of decision
(1) After considering all representations made under section 17 (4) about the
proposed declaration, the Minister must— (a) decide whether to make the
declaration; and
(b) give notice of the decision to— (i) each person who
made the representations; and
(ii) the trustee of the relevant land, if the
trustee did not make any representations.
(2) The Minister may, after
considering the representations, decide to make the declaration for all or a
part of the relevant land described in the notice under section 17 .
(3) If
the Minister decides to make the declaration, the notice must— (a) include a
description of the relevant land to be declared not transferable under this
division; and
(b) state all of the following— (i) the provision under which
the declaration is to be made;
(ii) the reasons for the decision;
(iii) if
the Minister is to make the declaration under section 16 (1) (d) —that a
person who made representations about the proposed declaration may appeal
against the decision to the Land Court within 28 days after receiving the
notice, and how the person may appeal.
