Appointment and qualifications
104 Appointment and qualifications
(1) The chief executive may appoint any of the following persons as an
authorised person to investigate, monitor and enforce compliance with this
Act— (a) a public service employee;
(b) a person prescribed under a
regulation.
(2) The chief executive officer of a local government may appoint
any of the following persons as an authorised person to investigate, monitor
and enforce compliance with this Act— (a) an employee of the local
government;
(b) a person prescribed under a regulation.
(3) However, the
chief executive or chief executive officer (each the
"designated officer" ) may appoint a person as an authorised person only if
the designated officer is satisfied the person is qualified for appointment
because the person has the necessary expertise or experience.
