ANIMAL MANAGEMENT (CATS AND DOGS) ACT 2008 - SECT 43U
Immediate suspension
(1) The chief executive may decide to suspend a person’s registration as a
registered breeder immediately if the chief executive believes— (a) a ground
exists to take proposed action in relation to the person’s registration; and
(b) it is necessary to suspend the registration immediately because there is
an immediate and serious risk— (i) to the welfare of dogs; or
(ii) of harm
to the effectiveness of the registration of persons as registered breeders
under this Act.
(2) The chief executive must, as soon as practicable after
making the decision, give the person— (a) an information notice for the
decision to suspend the registration immediately; and
(b) a show cause notice
in relation to the proposed action.
(3) The suspension— (a) takes effect
when the notices are given to the person; and
(b) continues until the
earliest of the following— (i) the chief executive ends the suspension;
(ii) the show cause notice is finally dealt with;
(iii) the day that is 28
days after the notices were given to the person.
