Attempt to commit offence
122 Attempt to commit offence
(1) A person shall not attempt to commit an offence against this Act.
(2) A
person convicted of the offence of attempting to commit an offence against
this Act is liable to the same penalty as an offender convicted of the offence
itself unless the person proves that the person desisted of the person’s own
motion from the further prosecution of the person’s intention without its
fulfilment being prevented by circumstances independent of the person’s
will, in which case the person is liable to one-half of the penalty to which
the person would otherwise be liable.
(3) The Criminal Code , section 4
applies with respect to an attempt to commit an offence against this Act.
(4)
A person may be convicted of attempting to commit an offence upon a complaint
charging the person with that offence.
