(1) Subject to sections 5 (3) and 59A , this Act does not create or confer any
cause of civil action for the recovery of damages.
(2) A provision of this
Act that gives protection from civil liability does not limit the protection
from liability given by another provision of this Act or by another Act or

sections 96E , 96F and 96G

the Nature Conservation Act 1992 , section 142

Recreation Areas Management Act 2006 , section 228 .
(3) This Act, other
than chapter 2 , part 2 and chapter 3 , does not prevent the parties to a
contract from making express provision for their rights, obligations and
liabilities under the contract (the
"express provision" ) in relation to any matter to which this Act applies and
does not limit or otherwise affect the operation of the express provision.
(4) Subsection (3) extends to any provision of this Act even if the provision
