32 Show cause process

(1) Before making a decision under section 31 about an expunged conviction or expunged charge, the chief executive must give the applicant for the expungement of the conviction or charge a notice (a
"show cause notice" )—
(a) stating the chief executive proposes to decide that the expunged conviction or expunged charge is no longer an expunged conviction or expunged charge (the
"proposed decision" ); and
(b) informing the applicant of the reasons for the proposed decision; and
(c) inviting the applicant to make a submission to the chief executive, within a stated period, in relation to the proposed decision.
(2) The applicant may make a written submission about the show cause notice to the chief executive in the period mentioned in subsection (1) (c) (an
"accepted submission" ).
